Limited Warranty Terms
Issued by: Kunshan ZhengBai Electromechanical Co., Ltd. (“Seller”)
Effective Date: April 29, 2026
1.1 The Product is covered by a limited warranty for twelve (12) months from the date of shipment by the Seller. Under normal use and proper maintenance, the warranty covers defects inherent in the raw materials and workmanship.
1.2 Any repaired or replaced part or unit shall only inherit the remaining warranty period of the original Product. Repair or replacement does not extend or restart the original 12‑month warranty period. Unless mandatory under applicable law, a replacement part does not receive a new warranty period.
This warranty does not cover any damage or defect caused by:
- (i) misuse, overload, rough handling, lack of maintenance, improper installation, or storage under unsuitable temperature/humidity conditions;
- (ii) external electrical faults: power surges, lightning, grid anomalies, or electrical shock from incompatible power supplies;
- (iii) disassembly, modification, or repair without the Seller’s prior written authorization;
- (iv) normal wear and tear: fading of the housing, blurring of labels, or normal wear of connectors;
- (v) physical damage: cracked housing, dropping, water ingress, cut cables, or deformed plugs;
- (vi) use with incompatible wheelchairs, batteries, controllers, or non‑standard power adapters;
- (vii) expiration of the 12‑month warranty period.
3.1 For defects confirmed to be within the warranty coverage, the Seller shall first repair or replace the defective part or unit. Only when the product cannot be repaired and no replacement stock is available may the Seller issue a refund or account credit. Under no circumstances will the Seller proactively provide a full cash refund.
3.2 The Seller shall bear the material and labor costs for warranty repair or replacement. The Buyer shall bear the outbound shipping cost to send the defective product to the Seller’s facility. The Seller shall bear the return shipping cost to send the repaired or replaced product back to the Buyer (within the same country/region). For cross‑border shipments, any customs duties, clearance fees, and storage charges shall be borne solely by the Buyer.
3.3 If the Seller determines after inspection that the defect falls under the exclusions listed in Article 2 (e.g., misuse, unauthorised disassembly, voltage surge), the Buyer shall bear all round‑trip shipping costs and any professional inspection fees.
4.1 The Buyer must provide written notice by email (zb@zbcharger.com) before the 12‑month warranty period expires, attaching proof of purchase, clear photos/short video of the defect, and the serial number (if any). An email is deemed effectively delivered upon sending; the Buyer is advised to also copy a backup email address to avoid missing notifications.
4.2 Do not return the defective product without an RMA authorisation. After the Seller’s approval, an RMA number and detailed return instructions will be sent by email. The Buyer shall ship the product back within 30 days after receiving the RMA; otherwise the RMA will automatically expire (the Buyer may reapply during the warranty period). If the Buyer repeatedly and maliciously delays the return, the Seller may reject the warranty claim.
4.3 If the Buyer fails to provide written notice before the warranty period expires, the Product shall be deemed free from defects at the time of delivery, and the Buyer may not make any subsequent claim for the same defect.
5.1 Under no circumstances shall the Seller be liable for any indirect, incidental, special, or punitive damages, including but not limited to:
- damage to the wheelchair, battery, controller, or any third‑party equipment;
- loss of profit, revenue, orders, or business interruption;
- loss of goodwill, downtime, or third‑party claims;
- arbitration fees, attorneys’ fees, expert witness fees, travel expenses, preservation costs, or enforcement costs.
Even if the Seller has been advised of the possibility of such damages, the Seller shall have no liability whatsoever.
5.2 The Seller’s total aggregate liability for any claim (whether based on contract, tort, warranty, or otherwise) shall not exceed the lesser of:
(i) the actual purchase price paid by the Buyer for the defective product (unit price × quantity of defective units); or
(ii) 100 USD.
This limitation does not apply to personal injury caused by a proven product defect where mandatory local law prohibits such limitation. For all other property and economic losses, this cap shall be strictly enforced.
5.3 To the maximum extent permitted by law, the Seller expressly disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non‑infringement, and quiet enjoyment. This Product is sold as a wheelchair charger, and the Seller makes no express or implied warranty that it is compatible with any specific wheelchair brand, battery system, or custom application.
6.1 Entire Agreement: This warranty constitutes the Seller’s sole and complete statement of warranty obligations and shall be read together with the Refund & Return Policy and the Shipping & Delivery Policy. In the event of any inconsistency between these documents, this document shall prevail; if this document does not address a particular matter, the terms more favorable to the Seller and not contrary to mandatory PRC law shall apply. This warranty supersedes all prior or contemporaneous oral or written communications.
6.2 Severability: If any provision of this warranty is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
6.3 Governing Law & Arbitration: This warranty shall be governed by the laws of the People’s Republic of China. Any dispute arising shall first be resolved through friendly email negotiation. If negotiation fails, the dispute shall be finally settled by the Kunshan Arbitration Commission through binding arbitration. The losing party shall bear all arbitration fees, appraisal fees, attorneys’ fees, travel expenses, preservation costs, and enforcement costs.
6.4 Amendment: The Seller reserves the right to amend this warranty by posting the updated version on the official website (zbcharger.com). Orders already placed shall be governed by the version in effect at the time of order confirmation.
6.5 Delivery of Notices by Email: Official notices, RMA documents, inspection reports, warranty notifications, and claim letters sent by either party to the other’s designated official email address shall be deemed effectively delivered at the moment of sending. The receiving party is responsible for maintaining a functioning mailbox; failure to read the email does not affect the validity of delivery.
6.6 Language: The Chinese version of this warranty is the sole authoritative version for interpretation. Any translation into another language is for reference only and has no legal effect. In case of any discrepancy, the Chinese version shall prevail.
6.7 Force Majeure: Events such as natural disasters, flight/port closures, customs policy changes, international sanctions, raw material supply disruptions, epidemics, strikes, government regulations, or other force majeure events that cause delays in inspection, repair, replacement, or shipment shall not be deemed a breach. The affected party shall notify the other by email within 3 working days and provide supporting evidence, and the time limits shall be reasonably extended.
6.8 Custom / OEM Orders: Customised or OEM non‑standard bulk orders are subject to this 12‑month warranty by default. If the parties enter into a separate written agreement providing for a different warranty period, that separate agreement shall control.
